These Terms of Use ("Terms") govern your use of everdream.co (the "Site"), operated by EverDream ("EverDream," "we," "us"). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
These Terms apply to your use of the Site as a visitor. They do not govern our paid services. Any engagement to provide services is governed by a separate Master Services Agreement ("MSA") and Statement of Work ("SOW") signed by EverDream and the client. If anything in these Terms appears to conflict with a signed MSA or SOW, the MSA and SOW control for that engagement, and these Terms do not apply to it.
EverDream provides marketing and content services — such as copywriting, website work, SEO, and email marketing — primarily for small and bootstrapped businesses. Descriptions of services on the Site are for general information and are not an offer or a guarantee of any specific result.
Unless noted otherwise, the Site and its contents (text, graphics, logos, wordmarks, images, audio, video, and their arrangement) are owned by EverDream and protected by copyright, trademark, and other laws. You may view the Site for your own personal, non-commercial use. You may not copy, reproduce, republish, scrape, sell, reverse engineer, or create derivative works from Site content without our written permission, and you may not remove any proprietary notices.
You agree not to use the Site in any way that is unlawful, that could damage, disable, or overburden it or interfere with others' use, or that attempts to gain access to areas or data not intended to be public.
The Site may link to third-party websites we do not control. We provide these links for convenience only; we are not responsible for the content, products, or practices of any linked site, and a link is not an endorsement.
Your use of the Site is subject to our Privacy Policy, which explains what personal information we collect and how we use it. Please review it.
The Site is not directed to children under 13, and we do not knowingly collect personal information from them. If you are under 18, please use the Site only with a parent's or guardian's permission.
The Site and its content are provided "as is" and "as available." We make no warranties, express or implied, about the accuracy, reliability, or availability of the Site, and disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law. Site content may contain errors or be updated at any time.
To the maximum extent permitted by law, EverDream will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising out of your use of or inability to use the Site. If you are dissatisfied with the Site, your sole remedy is to stop using it. Nothing here limits liability that cannot be limited under applicable law. (This section concerns the Site only; liability for paid engagements is addressed in the MSA.)
